Limitation of Liability To the maximum extent permitted by law, IN NO EVENT shall Putanko, its owners, directors, employees, partners, affiliates, or suppliers be liable for any damages whatsoever, including but not limited to: direct or indirect damages incidental, special, consequential, or punitive damages loss of profits, revenue, data, business opportunities, or reputation damages arising from AI-generated content, user prompts, or third-party AI models decisions made or actions taken based on AI-generated outputs This limitation applies regardless of the legal theory, including contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages. If liability cannot be fully excluded under applicable law, our total liability shall be strictly limited to the amount paid by you to the Company during the twelve (12) months preceding the claim. 16. Indemnification You agree to indemnify and hold harmless Putanko from claims arising out of: Your use of the Service Your generated content Your violation of these Terms 17. Termination We may suspend or terminate your account immediately for violations of these Terms. Upon termination: Access to the Service ends Unused credits are forfeited 18. Changes to These Terms We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms. 19. Governing Law These Terms are governed by the laws of Croatia, without regard to conflict-of-law rules. 20. User Responsibility & Indemnification You agree to fully indemnify, defend, and hold harmless Putanko from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to: your use or misuse of the Service any AI-generated content you create, publish, distribute, or monetize violations of applicable laws or third-party rights commercial use of AI-generated images or videos any dispute, claim, or legal action related to AI-generated content 21.
